"USER" (CUSTOMER) is an able-bodied person who has agreed to these General Terms and Conditions in connection with the ordering and purchase of goods offered through the e-shop.
"E-SHOP" is the Internet site LoveYourCurvy.com, which serves as a virtual platform for offering goods for sale and for reaching an agreement between SELLER and USER for the purchase and sale of a particular product.
LoveYourCurvy is a trademark of Saron EOOD, UIC: 203939230, based in Sofia, which creates and maintains the e-shop, sells goods in the store and defines these General Terms and Conditions. Saron EOOD has the full rights to unilaterally change the content of the Internet site, including the present general conditions, as well as the ways of access to it.
"ORDER" - this is an action that indicates the request made by the User to purchase one or more specific goods (products) through the online store LoveYourCurvy.com. Each first order is executed only after confirmation by the administrator of the site LoveYourCurvy.com by phone call to the CUSTOMER / USER who made the purchase order. Subsequent orders can be executed without confirmation by the administrator of the site LoveYourCurvy.com by phone call to the CLIENT / USER only for registered users.
"SALES AGREEMENT" - the contract for purchase and sale of goods concluded at a distance through this e-shop between the Seller and the User.
"COURIER" is a trader who physically delivers the purchased goods to the address specified by the User and works under the requirements of the Postal Services Act.
"BROCHURE / NOTICE / BULLETIN" are electronic information messages relating to goods and services sold in the e-shop or to changes made in the e-shop, during a certain period of time, which may be posted on the website, and may be send by e-mail or other channel to a User.
2.1. Browsing the online store LoveYourCurvy.com is completely free and accessible from anywhere in the world.
2.2. All texts, images and multimedia content on the site LoveYourCurvy.com are the property of "Saron" Ltd.! It is forbidden to copy, transmit, distribute and store part or all of the content in any form without the prior written consent of Saron EOOD! For contacts - email@example.com
2.2.1. There may be a discrepancy in the color range of the products shown in the photos and the real ones, depending on the screen of the device on which the User views them, for which the Merchant is not responsible.
2.3. No changes, reproduction, distribution, direct transmission, display, presentation, reproduction, publication, authorization or sale of information owned by Saron EOOD are allowed.
2.4. To shop from the LoveYourCurvy.com e-shop, the following information is required: e-mail (optional), recipient's names (required), telephone and delivery address (required).
2.5. All prices listed on the site are in BGN with VAT included.
3. ORDER OF GOODS AND PRODUCTS
3.1. To place an order from the e-shop, the User must specify:
3.1.1. valid email address (optional);
3.1.2. correctly filled in address for delivery of the goods and invoicing (obligatory);
3.1.3. correctly filled in contact details - two names, telephone (required).
3.2. The order is activated, ie. Apply to the e-shop by clicking the "Order" button, which appears after at least one product has been selected using the "Add to cart" button.
3.3. Upon placing an order, the User receives a confirmation of the order at the e-mail address specified by him (if he has indicated such), and in the confirmation the number of the order, the date and time in which the order was placed are indicated. If no contact email is provided, the User receives an order confirmation only by phone call from an administrator of LoveYourCurvy.com.
3.4. In case the ordered product (specific model) is not available, the administrator of the site LoveYourCurvy.com notifies the User. If the User does not agree to place the order for another product (similar model), the order can be changed or canceled.
3.5. Orders in the e-shop LoveYourCurvy.com are accepted 24 hours a day, 7 days a week by the site's system.
3.5.1. The working hours of the administrators of the e-shop LoveYourCurvy.com are from Monday to Friday, from 9:00 to 18:00 and on Saturday from 9.30 to 13.30. Online product consultations can be conducted during store hours.
3.5.2. All orders placed before 2 pm are processed and shipped the same day.
3.5.3. All orders placed after 2 pm are usually processed the next business day.
3.6. Orders received without correct data of the buyer (User) or missing ones are placed under the status "Pending" until we receive the full set of data about the User.
3.7. The user can refuse an order without having to mention the reasons for the refusal.
3.8. Cancellations can be made by phone or by e-mail (email) to the email specified on the site: firstname.lastname@example.org. In order for the refusal to be valid, the User must provide: his two names with which he is registered on the site or has sent the order, a telephone number for contacting the order, as well as the number of the order.
4. DELIVERY OF ORDERED GOODS
4.1. After an order from a User is received on the LoveYourCurvy.com site, the automated system of the e-shop notifies the User by e-mail (if he has indicated such) of the successfully accepted order.
4.2. Delivery is made only on orders confirmed by the site administrator. Confirmation is done by phone for each first order of the specific customer. Each subsequent order can be confirmed by the site administrator, without necessarily being agreed with the customer by phone.
4.3. The delivery of the ordered goods is not made on weekends and public holidays, unless the customer expressly wishes to receive his order on such a day. In this case, the generated additional courier fees for delivery on weekends or holidays are at the expense of the customer.
4.3.1. Normal delivery - within 2 (two) working days from the moment of order confirmation. This period may be extended during heavier campaign periods, national holidays or bad weather. The terms for international deliveries are indicated in item 4.6.
4.4. The e-shop LoveYourCurvy.com uses for deliveries courier companies Econt Express, Speedy and for international shipments - the Global Postal Network and DPD, as the usual delivery hours are from 9.00 to 17.30.
4.5. Delivery is made to the address specified by the User or to the office of the respective courier company.
4.6. The price of delivery for orders under BGN 89 to an Econt or Speedy office is BGN 5-6, and to a customer's personal address is BGN 7.
All orders over BGN 89 have FREE delivery to a courier office, and all orders over BGN 120 have FREE delivery to any point in Bulgaria. The prices and terms for international shipments are:
- For Romania and Greece - price 9 €, delivery time 3-4 working days.
- For Hungary, Czech Republic, Croatia, Slovenia, Slovakia, Poland - 12 €, delivery time 5-6 working days.
- For all other EU members - from 17 €, delivery time 5-6 working days.
- For all other European countries, not EU members - from 20 €, delivery time 5-7 working days.
- For the rest of the world - from 22 €, delivery time to the USA 7-14 working days, delivery time to Australia, Canada and other countries 10-21 working days
4.7. If the User does not provide access and conditions for delivery of the goods to the specified address within the specified period, the Seller is released from the obligation to perform the requested delivery.
4.8. For the models from the "PROMO" category, different delivery conditions can be defined, which will be displayed on the promotion page.
5.1. Payment for the ordered goods can be made in one of the following ways:
5.1.1. Payment in cash or at a POS terminal upon receipt of the shipment (cash on delivery);
5.1.2. Payment through our site with the user's bank card, through a virtual POS terminal.
5.1.3. Payment for international orders is possible only through our site with the user's bank card, through a virtual POS terminal.
6. WITHDRAWAL FROM THE CONTRACT. COMPLAINTS OF GOODS / ORDER. REPLACE.
6.1. The consumer has the right to claim or withdraw from the contract for goods purchased from the e-shop within 14 days of receipt of the goods.
6.1.1. Withdrawal from the contract for purchased goods can be made for the following reasons: the product is too big, too small, the material is not what the User expected, the User does not like the way the model looks, does not like the color, other reasons that The user is not required to specify.
6.1.2. Complaints can be made for the following reasons: the model is damaged / defective / dirty, the User has received a completely different model from the one who ordered, the User has received a different size or color from the one who ordered.
6.1.3. In case of refusal and / or complaint, the User may request replacement of the returned goods or refund of the paid funds.
6.2. The contract can also be canceled in front of the courier upon delivery of the goods.
6.3.1. In case of withdrawal from the contract and / or request for replacement, the User is obliged to return the purchased one and goods in undamaged commercial form - the product is not carried outside, but only tested at home and the original packaging and labels are not removed; the product has not been treated (washed and / or hungry and / or etc.), not contaminated or damaged.
6.3.2. In case of a complaint, the User is obliged to return the purchased goods in the form in which they were received without trying to eliminate the identified defects / damages / contaminants. The product should not be worn outside, but only tested at home and the original packaging and labels should not be removed; the product has not been treated (washed and / or hungry and / or etc.), it has not been additionally contaminated or damaged.
6.3.3. In case of non-compliance with the conditions under item 6.3.1. and 6.3.2., the return cannot be accepted. Printed tights are not subject to a right of withdrawal and cannot be returned or replaced.
6.4. Complaints and / or withdrawal from the contract (return) and / or request for replacement can be submitted to "Saron" Ltd. through the return form published on the online store LoveYourCurvy.com, email email@example.com or online inquiry system on the site and at the same time the User must return the goods within 14 working days.
In the comment field when using the return form, in the email or the contact form on the site, the User should indicate a bank account for refund and / or information for desired replacement (name of the new product, size, color). This information may also be provided by attaching a note to the returned consignment.
6.5. The return of goods, either in case of withdrawal from the contract, or in case of a complaint, or in case of a request for replacement, can be done as follows:

Upon request for replacement, the new item is sent as soon as possible after the returned product is accepted by the site administrator and made sure that it is intact.
6.6. Costs for courier services in case of return or exchange:
6.6.1. The costs for courier services when returning a product in case of withdrawal from the contract are at the expense of the customer. Returns sent by cash on delivery and / or at the expense of the e-shop cannot be accepted.
6.6.2. The costs for courier services in case of exchange are at the expense of the customer in one direction: the return is at the expense of the customer, and the sending of the new item is according to the standard delivery conditions of the e-shop - at the expense of the store. for delivery to a courier office or if the order is over BGN 120 for delivery to a personal address.
6.6.3. All courier costs for returns and replacements made due to delivery of the wrong or damaged item (complaint) are entirely at the expense of the e-shop and completely free for the customer.
6.7. After the returned products arrive and the site administrator makes sure that they are in undamaged commercial form, a refund of the amount paid by the User without delivery (if paid) within 15 days of receipt of the returned product. Reimbursement is made only by bank transfer to the account of the User, the data for which should be provided as provided in item 6.4. way. In case the payment is made with a bank card, the refund is made by ordering a reverse operation on the same card. Amounts are not refunded until the User returns the goods. If the goods are not returned within 14 days, the withdrawal from the contract or the request for replacement may not be accepted. In case of difficulties and delays of the courier and postal services due to a busy period or other objective reasons (such as emergencies, Christmas and New Year holidays, Black Friday), the e-shop may accept a longer period for returning the goods.
6.8. In case of complaint and / or withdrawal from the contract (return), the User may choose to replace the specific item for the same without defects or in another size, or another color, or return the goods against a refund. An administrator of the e-shop LoveYourCurvy.com can offer the exchange of the item for another item, refund in the form of a credit or voucher. In case of exchange for a product at a lower price, the difference is refunded to the User. The administrator of the e-shop LoveYourCurvy.com can offer the difference to be reimbursed in the form of a credit or voucher.
6.9. In the event of a dispute that cannot be resolved jointly, you may use the ODR site. All products on the page are subject to update. The information on the page can be changed at any time, and the changes do not have to be announced on the page.
7. INFORMATION ON THE RIGHTS OF THE CONSUMERS, ARISING FROM THE LEGAL GUARANTEE UNDER ART. 112-114 OF THE CPA.
In case of discrepancy of the consumer goods with the contract of sale the consumer has the right to file a complaint by asking the seller to bring the product in accordance with the contract of sale. In this case, the consumer can choose between repairing the product or replacing it with a new one, unless this is impossible or the method of compensation chosen by him is disproportionate to the other.
A way of compensating the consumer is considered to be disproportionate if its use imposes costs on the seller, which in comparison with the other way of compensation are unreasonable, taking into account: 1. the value of the consumer goods, if there was no lack of non-compliance; 2. the significance of the non-compliance;
the possibility to offer the consumer another way of compensation that is not associated with significant inconvenience for him.
When the consumer goods do not comply with the sales contract, the seller is obliged to bring them in line with the sales contract.
The bringing of the consumer goods in accordance with the sales contract must be done within one month from the filing of the complaint by the consumer.
After the expiration of the term under par. 2 the consumer has the right to cancel the contract and to be reimbursed the amount paid or to request reduction of the price of the consumer goods according to art. 114.
Bringing the consumer goods in line with the sales contract is free of charge for the consumer. It does not owe costs for the shipment of consumer goods or for materials and labor associated with its repair, and must not suffer significant inconvenience.
The consumer may also claim compensation for the damage suffered as a result of the non-compliance.
In case of non-compliance of the consumer goods with the contract of sale and when the consumer is not satisfied with the resolution of the claim under Art. 113, he has the right to choose between one of the following options:
cancellation of the contract and refund of the amount paid by him;
The consumer may not claim a refund or a reduction in the price of the goods when the trader agrees to replace the consumer goods with a new one or to repair the goods within one month of the consumer's complaint.
The trader is obliged to satisfy a request for cancellation of the contract and to refund the amount paid by the consumer, when after satisfying three complaints of the consumer by repairing the same product there is another occurrence of non-compliance of the product with the contract of sale.
The consumer cannot claim for cancellation of the contract if the non-compliance of the consumer goods with the contract is insignificant.
8.1. The Seller of the goods is responsible for defects in the goods, for the performance of the distance selling contract, as well as for the refund of amounts paid.
8.2. Saron EOOD does not bear any responsibility to third parties if such a person considers that information published on the e-shop infringes someone's copyright or other intellectual property rights.
8.3. Saron EOOD does not bear any responsibility for incorrectly filled in data and information from the User, including, but not limited to, incorrectly requested data for refund of amounts returned.

11. PRIZE POINTS.
11.1. Saron EOOD may award reward points for certain actions by the user. Reward points are granted only to registered users.

11.3. If the user wants to use points to pay for a product or part of it, this is done by entering the number of points he wants to use in the column "Use coupon, voucher or points" before sending an order. The system will generate a discount from the order in the amount of the BGN equivalent of the entered points. The customer decides whether to use all the accumulated points for one purchase or to use only part of the points for the specific purchase. The difference between the value of the order and the value paid by points is paid through one of the other payment options.
11.4. Reward points are received when purchasing products from LoveYourCurvy.com. The number of points that the User will receive for each purchased product are displayed on the product page.
11.4.1. Additional reward points may be awarded by a LoveYourCurvy.com administrator as compensation for delay, cancellation or error in sending an order; in special campaigns and / or to stimulate certain actions by the User.
11.5. In the event of a complaint, the following conditions apply:
11.5.1. If the product for which points have been received is returned, then the points used for this product will be reflected as a (-) minus in the customer profile of the customer.
11.5.2. In cases where the Customer has used points to reduce the value of an order, but subsequently returns the entire order, the points used will be refunded to his user profile.
11.5.3. If the Customer partially returns an order, the points used proportionally to reduce this product from the total order will be partially returned, according to the share of the returned product from the total order (example: for an order of BGN 100, consisting of 2 products of BGN 50 each and used 100 points, in case a product of BGN 50 is returned, 50 points will be returned to the Customer in his account).
11.6. The accumulated points can be checked by the Client at any time in his user profile on LoveYourCurvy.com.
11.7. In case of suspicion of fraud regarding the receipt and use of promotional points, Saron EOOD reserves the right to unilaterally cancel any distribution or use of points, without the User having the right to claim compensation or the equivalent of these points.
11.8. Saron EOOD can change the mechanism unilaterally, without the consumers being able to demand compensations for not granting or canceling reward points. The validity and value of the points are subject to change during the various campaigns without notice. Reward points cannot be exchanged for their monetary equivalent.
12.1. Bonuses are amounts deposited in the User's profile. Bonuses are loaded only for registered users.
12.2. Bonuses are loaded into the User's profile by an administrator of LoveYourCurvy.com at his discretion in the following cases:
12.2.1. As a birthday present for the consumer.
12.2.2. When a customer returns an order and wishes to refund the amount in the form of a credit for subsequent purchases.
12.2.3. When generating a difference when replacing products of different values, which should be stated by the consumer.
12.2.4. As compensation for delay, cancellation or wrong order.

12.3. The bonus loaded in the User's profile is automatically deducted from the next order. Bonuses cannot be converted into BGN and can only be used on the LoveYourCurvy.com website. Bonuses cannot be used outside the account in which they are loaded, cannot be transferred to another account and cannot be used for purchases from other customers.
12.4. In case of return of products for which a bonus with a fixed amount has been applied, the proportional value used by the bonus is refunded in the User's profile.
10. GIFT VOUCHER
10.1. Anyone wishing to make a gift can purchase a Gift Voucher with the desired value by filling in the details of the recipient and the sender. The gift voucher is sent to the recipient by e-mail.
10.2. A gift voucher can be purchased online here (link).
10.3. A gift voucher can be purchased online with a bank card, PayPal or bank transfer. The value of the Gift Voucher is equal to the amount paid by the Customer when purchasing it.
10.4. The value of the Gift Voucher is determined and entered by the customer.
10.5. The gift voucher mo to be used only once, within its value, only for products available on the LoveYourCurvy.com website and is valid for a period of six months from the date of its issuance and sending it to the recipient. After this period, the Gift Voucher expires automatically.
10.6. The value of the purchased products must be equal to or greater than the value of the Gift Voucher. The value of the Gift Voucher is deducted from the total value of the order basket. If the total value of the products in the order basket is lower than the value of the Gift Voucher, this difference is lost, not saved / transferred to the Customer's account.
If the total value of the order exceeds the value of the Gift Voucher, the difference can be paid with all means of payment provided by LoveYourCurvy.com.
10.7. The gift voucher is delivered only in electronic format. The recipient will receive it in their email as soon as the payment is processed. The voucher can be used immediately upon receipt and does not require additional activations or other actions.
The gift voucher is issued with a unique code, which is entered in the "Use voucher" field when ordering from LoveYourCurvy.com.
10.8. The gift voucher cannot be turned into BGN and cannot be used outside the LoveYourCurvy.com website.
10.9. In case of suspicion of fraud regarding the receipt and use of a Gift Voucher, Saron EOOD reserves the right to terminate or cancel unilaterally any use of a Gift Voucher, without the user (Customer) having the right to claim compensation for lost benefits or the equivalent of The gift voucher in cash.
10.10. If the Customer or the User of the Gift Voucher wishes to return the product / products purchased with the Gift Voucher, the value of the returned products purchased with the Gift Voucher is refunded in the form of a cash bonus or voucher in the Customer's profile.
